In most cases, the Court will take a position that a prior warning is required unless the conduct of the employee makes it impossible to continue the employment. It is also important to understand that in Ontario not every termination for cause disentitled employees from the reasonable notice upon termination or Severance Pay. ESA states that the employee is not entitled to termination pay only in cases of wilful misconduct, disobedience, or wilful neglect of duty that is not trivial and has not been condoned.
