Negotiating fair and equitable severance agreements is our forte. Whether you’re an employee seeking the best possible package or an employer looking to ensure compliance, we have you covered. It is always a good idea to have legal advice secured before offering or accepting the Severance package. Mistakes in Employment Law are costly and there is a tendency in the Court’s decision to award punitive damages against those employers who attempt to circumvent the requirements of the Employment Standards Act (ESA) or were otherwise unreasonable upon termination.
This type of termination is one of the most challenging and emotion-driven. On the one side, employers are frustrated with the necessity to bear harm and damages caused by the employee’s conduct, but the employee’s intentions and state of mind can justify the action that is seen as a “cause”. It is important to keep in mind that if a “cause” exists, the law requires employers to use termination as a last resort measure and not an automatic right. In most cases, the Court will take a position that a prior warning is required unless the conduct of the employee makes it impossible to continue the employment. It is also important to understand that in Ontario not every termination for cause disentitled employees from the reasonable notice upon termination or Severance Pay. ESA states that the employee is not entitled to termination pay only in cases of wilful misconduct, disobedience, or wilful neglect of duty that is not trivial and has not been condoned. Navigating terminations can be challenging.
