What Does a Divorce Lawyer Cost in Toronto?

The honest answer is that it depends far more on how much your spouse disagrees with you than on which lawyer you hire. Two people who agree on everything can be divorced for a few thousand dollars. The same two people fighting over parenting time and a business valuation can spend fifty times that.

Below are the ranges we see across Ontario in 2026, what moves a file from the low end to the high end, and how billing actually works, so you can budget before you commit to anything.

Court fees are fixed, and everyone pays them

These are government fees, not legal fees. They apply whether you use a lawyer or file the paperwork yourself:

What the market charges by hour

Family lawyers in Ontario generally bill $300 to $700 per hour, with the provincial median around $450. Toronto and GTA rates sit at the upper end of that range, typically $400 to $700, reflecting seniority and complexity of practice.

An hourly rate on its own tells you very little. A $700-an-hour lawyer who resolves your matter in twelve hours costs less than a $350-an-hour lawyer who takes sixty.

Typical total ranges by scenario

These are ranges observed across Ontario family law practice in 2026, per spouse. They are provided so you can plan. They are not a quote and not our fee schedule — see the note at the end.

Ontario also funds subsidised mediation through the Ministry of the Attorney General on a sliding income scale, from roughly $5 to $105 per hour. If money is the main obstacle, ask us about it at your consultation — we will tell you if you qualify even though it is not our service.

What actually moves the number

Almost every file that ends up costing more than the client expected does so for one of these reasons:

Whether you agree. This is the single biggest factor, and it dwarfs everything else. Agreement is the difference between the first row of that table and the last.

Children. Parenting time and decision-making responsibility generate more disagreement, and more court attendances, than any other issue.

Financial disclosure. If both sides produce complete documents promptly, costs stay predictable. If one side withholds, every motion to compel disclosure adds time and fees.

Assets that need valuing. A pension, a corporation, a professional practice, or real estate in dispute usually requires an expert. Expert reports commonly run $3,000 to $20,000+, and that is on top of legal fees.

Court motions. Each motion carries a filing fee of roughly $200 to $400 plus the preparation and attendance time behind it.

How your spouse’s lawyer works. You do not control this, and it affects your bill. A cooperative opposing counsel can save you thousands; an obstructive one can double a file.

Changes of position. Reopening issues that were already settled is one of the most expensive things a client can do.

How a retainer works

A retainer is money held in trust — it is your money until it is earned. We bill against it as work is done, and provide an itemised account showing time, task and rate.

Initial retainers in Ontario family matters generally run $1,000 to $5,000 for straightforward uncontested files and $5,000 to $30,000 where the matter is contested. If the retainer is depleted while your matter is ongoing, you will be asked to replenish it. You should never be surprised by this — ask at the outset what the likely total is and at what point a top-up becomes necessary.

For some straightforward uncontested matters, a flat fee may be available so you know the cost before you start. Whether your file qualifies depends on the facts, and we confirm it in writing before any work begins.

How to keep the cost down

• Settle what you can. Every issue you resolve directly is an issue nobody bills to argue.
• Come prepared. Gather income documents, account statements, property records and any existing agreements before the first meeting.
• Use email for questions, not the phone. A short written answer costs less than a call.
• Do not use your lawyer as a counsellor. It is the most expensive form of support you can buy, and a therapist is better at it.
• Consider mediation early. It is materially cheaper than litigation and works more often than people expect.
• Ask for a cost estimate at each stage and tell us your budget. We can often adjust the approach.
