In Ontario, an injured worker generally must file a claim with the WSIB within six months of the injury (or of learning of an occupational illness) using a Worker's Report (Form 6). Your employer must report within three business days (Form 7). Report early — delay can jeopardize your benefits.

You have the right to object. The first step is an Intent to Object, followed by a review at the WSIB's Appeals Services Division; if needed, the matter can be appealed to WSIAT. Each stage involves medical evidence and legal argument, which is where a lawyer is invaluable.

Yes. If modified duties pay less than your pre-injury earnings, you may receive partial Loss of Earnings benefits to make up the gap. Employers with return-to-work obligations must offer suitable work where possible.

WSIB pays for approved health care related to your injury and Loss of Earnings benefits of up to 85% of your net average earnings, subject to the WSIB's annual maximum. Time limits and review requirements apply.
