What Counts as Dental Malpractice in Ontario?
To succeed in a dental malpractice claim, Ontario law requires you to prove two things: a breach of the standard of care (your dentist failed to act as a reasonably competent professional would in the same circumstances) and causation (that specific failure – not your underlying dental condition – caused your injury).
Typical examples include an oral surgeon placing an implant into the inferior alveolar nerve, a dentist ignoring radiographic signs of infection, or years of missed periodontal disease that ends in tooth loss. Each claim turns on the dental records and on independent expert opinion – which is why we obtain and review your complete chart before advising you on the strength of your case.
