A collaborative family law process means you and your spouse and your respective family lawyers work as a team to find win-win solutions outside court, using four-way meetings or sessions. Unlike the court-based divorce process (where spouses are adversaries in court litigation and public proceedings), there is more open communication, privacy, and creative problem-solving for your unique situation.

Both spouses attend with their lawyers, and sometimes neutral expert professionals may participate (for example, financial experts, or a 'child specialist'). The focus is on joint goals/solutions, information sharing, and issue resolution via facilitated negotiations. The parties agree to talk respectfully and seek solutions with fairness and family health top-of-mind.

Collaboration gives you a dedicated advocate and legal support (unlike mediation, using a neutral third-party, or litigation, where a judge decides outcomes). You also have more control, and often lower costs, greater privacy, and a better relationship post-divorce.

  • Your collaborative lawyers: Represent each spouse, and help keep negotiations constructive.
  • A financial neutral: Assist with asset valuation, financial information-sharing, and division planning.
  • A child specialist: Provide input on parenting agreements, keeping children's needs first.

A parenting coordinator or child specialist may participate in meetings to guide creation of a custody plan and communication agreement, both child-centric and based on what is in your children's best interests. The process allows for creative, flexible, and child-friendly arrangements.

Yes. A financial expert such as a business valuator or accountant can join your team to handle any complex division of assets, business tax issues, or shared commercial arrangements. Full disclosure and professional guidance ensure transparency and fairness.

The entire collaborative process is private and cannot be used in any legal forum, due to your signed Participation Agreement. Collaborative divorce proceedings are not public record (as contrasted with court litigation.)

It can work as long as the parties respect the rules for open communication. Lawyers and other process 'coaches' can help manage issues if tempers flare - but both need to be committed to the process. If collaboration fails, you may have to step away or pursue other resolution methods.

If the process breaks down, the spouses each have to retain new family lawyers to continue to court litigation. (This important 'no court' clause in your Participation Agreement keeps everyone at the table focused on solutions.)

Once you reach resolution, your lawyers will draft your final settlement paperwork. You typically will not need to attend court (except to file for your divorce certificate or to formalize child custody or separation arrangements, if required).

The process is ideally focused on efficiency but not rushed; time to completion will vary by case complexity and parties' cooperation level. Simpler family law cases may be resolved in several months, while high asset or complex property, custody and parenting matters may take 6–12 months.

A Participation Agreement signed by you and your spouse prevents you both from continuing with your case/representation if you or they decide to leave the process to go to court. This ensures your lawyers remain 100% invested in a successful outcome at the table.

The process is less adversarial than other methods, helping keep conflict to a minimum and spouses focused on solution-building, instead of resorting to lawyers' litigation tactics. Confidentiality, child-focused meetings, and a dispute-resolution team also shield both parents and children from added anxiety.

Most collaborative lawyers in Toronto are members of Collaborative Practice Toronto, and the Ontario Association of Family Mediators. Look for a lawyer who is trained in the collaborative family law process as well as experienced in family law generally.

Collaborative law is most successful when both spouses are co-operative negotiators, are concerned about privacy, and want a solutions-focused or customized approach. The process is not suitable in cases involving power imbalances or coercion between the spouses, or if one spouse is unwilling to share relevant financial information.
