The mediation process is generally faster, less expensive, and enables the couple to maintain control over decision-making, while the court process involves strict rules of procedure, public disclosure, and a judge deciding the outcome.

Yes it can. Mediation is confidential and not involved in the public record of litigation unlike the court system. This protects your finances or personal circumstances from being broadcast outside the negotiating table.

Generally, children are not part of the sessions, but discussions remain child-focused. In some cases, the mediator may request the help of a neutral affiliate such as a social worker or counsellor (sometimes a 'child specialist') to bring the children's perspectives on certain issues - never eroding the child's interest.

The mediator can provide generic information about child support legislation and tables applicable in Ontario/Canada but does not provide legal advice. You still have the right to involve your own lawyer for review of any proposed separation agreement and to back up your rights according to provincial norms.

If mediation is unsuccessful, you always have the right to proceed to arbitration or litigation. Any partial agreements can be enforced, and only matters not settled at mediation need to be fought over in subsequent steps.

The mediator will respect your culture and religion as part of the discussions and keep them in mind in potential solutions around parenting, property and support. You can request acknowledgment of your background at your preference through the process.

Yes. Upon reaching full settlement, the mediator will memorialize terms in a written document ('memorandum of understanding'), with a separate lawyer for each spouse generally needed to execute a separation agreement, which when signed becomes legally binding and enforceable.

Expect to share at some point in the process copies of important financial (bank, credit card) and income verification (tax return, pay stub) documents as well as property-related paperwork (title, mortgage statements), child/spousal support amounts and so on - these will serve as reference materials for facilitated negotiations.

Virtual mediation offered through Zoom (or similar services) is widely available and often preferred - the process can be conducted from anywhere in Ontario. In-person mediation is optional and can be arranged if both parties agree.
