We have helped hundreds of couples through the divorce process involving property, support or custody/parenting disputes, and are attuned to the special issues that may arise in LGBTQ+ relationships while applying the same legislation and rules that govern all marriages in Ontario.

The same process applies to everyone, except where you were married in Canada but live in a place that won't recognize the marriage, leaving you unable to get divorced as well as disqualified from property division rights. In common-law relationships, you do not have property division rights with your former spouse regardless of whether you are in a same-sex or opposite-sex couple.

Non-bio parents may achieve their rights through second-parent adoption, declaration of parentage or a carefully drafted parenting agreement with a former partner.

Still treated the same as opposite-sex spouses, you are not entitled to equalization of net families' property under Ontario's family law. But you may have rights to spousal support or custody/access. We will identify your specific entitlements and provide for them in your separation agreement.

All cases are subject to privacy laws. Details about your relationship and orientation are only revealed if required by law, and we will do our best to keep these facts out of the court record.

We take measures from the start to present the case and our client's situation with the appropriate language and caselaw to protect the rights of LGBTQ+ Ontarians. We know all the family law judges and mediators in Toronto, and can ensure you are treated with dignity at every step of the process.

The same rules apply as for all married spouses: Family Law Act gives each spouse the right to equalization of net family property, with carve-outs for gifts, inheritances, etc. Businesses are evaluated based on contributions made via the marriage rather than on actual ownership.

A simple uncontested case will take 6–7 months; contested cases go at the pace dictated by the level of complexity.

Yes. Parentage may be established through an adoption or court declaration, securing custody/access and support rights with respect to your child.

We prefer to resolve the majority of divorces on consent and only approach the courts where a mediated or negotiated settlement is not possible.

Fees are determined on a case-by-case basis, with a transparent fee schedule discussed at your initial consultation. Payment arrangements can be made.

Divorce applications can only be filed if the parties are resident in Canada, with the exception of those who married in Canada and may be eligible under a new law Bill C-32. In cross-border family law matters we work with local counsel outside Ontario.

Spousal support is calculated using the same federal/provincial guidelines that set standards for all divorcing couples, with considerations around disparity in income, marriage length, child-rearing responsibilities, etc.

We can obtain a non-contested divorce for you after one year of separation, or take the case to trial to secure court orders relating to property or children.

Personal facts and information are exposed only when strictly required, and special care is taken to anonymize the court record and motion material for sealing where possible.

The rights of same-sex married spouses are identical to opposite sex couples under the Divorce Act and Family Law Act, with respect to spousal support, division of marital property, and custody/access.

You will need to show documentation supporting your parenting claim (eg, a surrogacy contract, donor agreement) and advocate for child custody/access orders that may reflect a non-traditional parenting arrangement.

The main thing is whether you and your spouse are on the same page regarding property, support or parenting matters, and the existence of a separation agreement will simplify the process greatly.
